10th February
Council of State Ruling N° 300/98: Carena's appeal is rejected, but Philipp Holzmann's is upheld. The contract awarded to IMPREGILO S.p.A is annulled.
13th February
Work is suspended.
Site is closed 229 days from the start of work, over seven months or almost 30% of the total contractual deadline.
Payment is made for work carried out by IMPREGILO, deemed complete and compatible with the Philipp Holzmann project, to the sum of Lit. 4,365,041,235 by way of settlement.
26th February
Judging Panel is convened again to carry out its competent tasks.
19th March
Judging Panel revises its calculations of points awarded to each tender, excluding the project submitted by IMPREGILO.
This mathematical calculation does not involve reassessing the tenders and the Panel's previous rulings and decisions remain unchanged.
Result: the contract is awarded to HOLZMANN.
The winning project does not comply with several urban planning laws, but seeing as the Council of State has granted special powers of interpretation, the project is deemed compatible in derogation to relevant legislation.
Approval for the project requires a modification to urban planning legislation or a derogation to the same.
15th April
Commissioner for Reconstruction applies to Head Office for a derogation to urban planning legislation (in accordance with Article 5 of Law N°. 225 of 24/02/92). Derogation is not granted.
15th May
IMPREGILO S.P.A. appeals against the Council of State's ruling.
Objection is made to the Council of State's ruling by the owner of one of the adjacent properties.
27th May
Works Management carries out surveys in accordance with Article 5 of Regional Law 350/1895.
2nd June
Following suspension of the IMPREGILO project, the closed site is assessed for compatibility with the new project.
1st July
Council of State turns down the appeals made by IMPREGILO and a private party.
July 1998 - February 1999
Decorative features made safe and site serviced under the direct management of the Commissioner for Reconstruction.
10th August
HOLZMANN's project is sent to the Commission for the Preservation of Venice.
8th September
Commission for the Preservation of Venice approves the project (with reservations).
City Council authorises the Mayor of Venice to take part in a meeting of the competent bodies to approve the draft agreement on amendments to existing urban planning regulations.
23rd December
Commissioner for Reconstruction purchases the two private properties adjacent to the South Wing of the theatre.
Application made to Commune of Venice regarding derogation to legislation in accordance with Article 80 of Regional Law N°. 61 of 27/06/1985.
