31st January
Under Order N° 13, Works Management sets a final ten-day deadline for the work schedule.
It is 596 days since work was assigned.
There are only 379 days to the deadline set out in the contract.

February
Based on the difficulties set out in the Superintendent's report, the Works Manager and Proceedings Manager are asked to contest Holzmann's failure to meet its contractual obligations, in accordance with public works legislation.

13th February
Holzmann delivers a new works schedule.
New date for completion of work (requested by Holzmann): 27/04/2003.

15th February
Proceedings Manager produces a report accusing Holzmann of breach of contract, in accordance with Article 27 of Royal Decree 350/1895, and requests that the contract be annulled due to serious negligence as regards the deadlines for completion of work.

16th February
Commissioner for Reconstruction sends Holzmann the Proceedings Manager's report, inviting Holzmann to state its own case.

23rd February
Holzmann submits its counter-statement with a declaration on the accusations.

28th February
Holzmann applies to the Civil Court for a technical survey of its work, then withdraws its request since there are no grounds for an appeal.
The appeal sets out a new completion date for work.
"May the contractual deadline [...] be moved to 18th January 2003, notwithstanding the further deadline for unrecognised work [...] of an additional 110 days".
New date for completion of work (requested by Holzmann): 08/05/2003.

8th March
Proceedings Manager and Works Management issue separate comments on Holzmann's declaration.

26th March
Holzmann informed that proceedings to annul the contract are underway. In view of Holzmann's approach to managing the contract and the content of its reply to the Proceedings Manager's report, the Commissioner for Reconstruction moves to annul the contract due to breach of the same to the prejudice of the contractor (in accordance with Article 340 of the public works law). Holzmann is given 30 days notice (as of 26/03/01) to deliver the site free of persons and objects, except safety equipment and apparatus.
Date for delivery of site: 25/04/2001.

29th March
State legal advisors requested to enforce guarantees of some Lit. 10 billion.

10th April
All work is suspended on site.

Preliminary notice issued prior to call for tenders to be published in the Official EU Gazette.

Ministry of the Interior issues an order authorising the Commissioner for Reconstruction to act in derogation to Article 24 of Law 109/94.

28th March - 20th April
By way of reply to representatives of Holzmann, Works Management prepares a report on the state of work and ascertainments required prior to release of the site.

23rd April
Architects from the Rossi group and supervisor Guenzani are called in to adapt the reconstruction project to new legislation, prior to the publication of a new call for tenders.
Estimated adaptation time: 60 days from delivery of documents - 24th June 2001.

Conclusion of ascertainments as regards the state of the site and extent of completed work, registered in 29 reports.

26th April
Holzmann refuses to release the site on expiry of the deadline set out in the annulment procedure.

Commissioner for Reconstruction officially approves the executive project (taken from the overall project) for provisional works and foundations.

27th April
City Authorities take possession of the site with the help of the police.

Completion work for the foundations is allocated to Dolomiti Rocce COSIDRA (a subcontractor for Holzmann) by private negotiation.

Completion of provisional work and foundations allocated urgently to Dolomiti Rocce COSIDRA.
Contract value: Lit. 6,750,000,000.
Contract deadline: 180 days.
Work to be completed: 24/10/01.

15th May
Appeal made regarding the technical survey: Holzmann claims that 33 errors were made during an inspection of finished building work by the Authorities. The Authorities dispute the admissibility and validity of the appeal.

30th May
President of the Court of Venice accepts the appeal and arranges for Office Technical Consultancy.

1st June
Contract drawn up with Dolomiti Rocce COSIDRA.

8th June
Holzmann gives notice that it intends to appeal against the possession order for the site.

21st June
New Director of Works appointed: Roberto Scibilia.

24th June
Ruling of monitoring authority for public works regarding ownership of the project operated by the Authorities, following approval of the same after the call for tenders.

26th June
Commissioner for Reconstruction officially allocates the job of adapting the project to "Aldo Rossi Associati", Edoardo Guenzani and Enzo Siviero.
Relative contracts are drawn up.
Contract value: Lit. 840,000,000.
Deadline for project documents: 30/06/01.

24th June
Commissioner appoints CONTECO SpA to validate the project. Relative contract drawn up.
Contract value: Lit. 160,000,000.
Contract deadline: 07/07/01.

13th July
President of the Court of Venice issues possession order requiring Holzmann to immediately dismantle its cranes and remove its machinery from the site.

16th July
Publication in the Official Gazette: private negotiation for an integrated contract for the executive project and reconstruction work in accordance with Article 9, Subparagraph 1 bis, of Law 109/1994.
Contract value: Lit. 104,000,000,000.
Applications to be submitted: by 12 pm on 03/08/01.

3rd August
Applications received by the following:

    4th August
    Commissioner for Reconstruction officially approves the final project and budget.

    6th August
    Carena informed that it has been excluded.

    7th August
    Applicants invited to submit tenders.
    Deadline for tenders: 12/09/01.
    Tenders to be opened: 13/09/01.

    13th August
    Carena appeals to the Regional Administrative Court of the Veneto; hearing adjourned to 5th September 2001.

    30th August
    Conference called to outline project and deal with any queries from participants.

    5th September
    Carena waives the adjournment; the Court sets a new date for a further hearing, 31st October 2001.

    7th September
    Commissioner issues letter extending deadline for tenders by a week.
    New deadline for tenders: 19/09/01.
    New date for opening tenders: 20/09/01.

    19th September
    Three tenders received:

    · Garboli S.p.A. (Rome) - Adanti S.p.A. (Bologna);
    · S.A.C.A.I.M. S.p.A. (Venice) - Cooperative Building Consortium (Bologna) - Gemmo Impianti S.p.A. (Arcugnano, VI) - Mantovani S.p.A. (Mestre);
    · Pouchain S.p.A. (Rome) - Gepco Salc S.p.A. (Milan) - Ingg. Giovannini e Micheli S.p.A. (Rome) - Cofathec S.p.A. (Rome).

    20th September
    Judging Panel opens the tenders and ranks reductions as follows:

    · S.A.C.A.I.M. - Cooperative Building Consortium - Gemmo Impianti - Mantovani: £.102.543.746.646 (1,40%);
    · A.T.I. Garbali - Adanti: £.102.780.000.000 (1,173%);
    · A.T.I. Pouchain - Gepco Salc - Giovannini e Micheli - Cofathec: £.103.168.000.000 (0,80%).
    The meeting is adjourned so that reductions can be assessed.

    4th October
    An architect who worked on the original project, Franco Laner, lodges an appeal at the Court of Milan in accordance with Article 700 of the Code of Civil Procedure, requesting that the project submitted for the competition be confiscated as his name no longer appears on it and he has been excluded from the task of adapting the project granted by the Commissioner (hearing of 19th October 2001).

    5th October
    Having established the suitability of the best bid, the Judging Panel awards the contract to Sacaim. The competition documents and final adjudication are approved by the Commissioner for Reconstruction on 8th October 2001.

    10th October
    The Proceedings Manager issues the company with Order N° 1 with immediate effect, prior to drawing up the contract for the executive project.
    80 days for the executive project: deadline 29th December 2001.

    18th October
    The Commissioner for Reconstruction lodges a petition with the Court of Venice seeking damages from Holzmann (over Lit. 120 billion) for breach of contract.

    29th October
    Gianni Cagnin appointed Works Manager.

    31st October
    Carena drops its appeal and the Regional Administrative Court of the Veneto annuls its ruling.

    2nd November
    Holzmann makes a claim for arbitration, seeking over Lit. 64 billion in damages from the Commissioner following the suspension of the contract and its removal from site.

    10th December
    Director of Works issues S.A.C.A.I.M. with Order N° 2 for part of the foundation work and requests the relevant extract from the executive project.

    20th December
    Commissioner for Reconstruction issues order to delay delivery of S.A.C.A.I.M.'s executive project by 31 days.
    Deadline: 28th January 2002.

    28th December
    Commissioner for Reconstruction issues order approving the amendment survey for "Dolomiti Rocce".
