| THE PRELIMINARY PROJECT
2.1 General standards
Designs for the rebuilding project are bound by strict
conservation requirements; while the aim is to rebuild La Fenice, it must
also be updated to meet new legislation. This applies both to the overall
layout of the theatre and the need to restore its previous acoustics as
described before.
Complying with current laws and legislation applicable to Venice is a
binding aspect of the rebuilding project.
The main framework of legislation includes the following (other regulations
are not mentioned here): the Building Regulations issued by the Commune
of Venice, Health Regulations, Regulations on the Conservation of Artistic
and Historical Heritage by which La Fenice is bound (Law 1089 of 1939,
Law 1497 of 1939); Town Planning Regulations and relative technical standards;
Conservation Legislation (Law 171 of 1973 and subsequent amendments);
and the "Galasso" Law (Law 431 of 1985).
Any improvements which do not comply with the reference legislation must
be illustrated and motivated in full.
Derogations can only be proposed when unavoidable topographical, functional/scenery-related,
artistic or acoustic obstacles mean that it is impossible to comply in
full with legislation.
Health and hygiene regulations governing the reconstruction of the theatre
concern the serving of food and labour and environmental laws, etc. (bars/restaurants
for public and staff use, for example).
Current legislation on the serving of food principally concerns the design
of areas used as bars and/or restaurants for public and staff use.
Law 283 of 1962 and the decree by which it came into effect (Presidential
Decree N° 327 of 1980) form the main frame of reference.
As far as working environments are concerned, Decree N° 626 governs
the use of space and many other related aspects.
Consideration must also be made of legislation governing residential areas,
access to and the use of designed spaces, sewerage systems, etc.
